Professional Estate Services Terms and Conditions.

  1. Services

Professional estate services provides professional non-intrusive damp surveying services carried out by a qualified damp surveyor.

The services available are

non-intrusive damp survey, £250,

pre-purchase damp survey, £375.

Surveys are carried out without removing or damaging skirting boards, flooring, or other parts of the property.

Where safe and reasonable access is available, observations may also be made within loft spaces, cellars, and basements.

2. Booking deposit:

A £100 deposit is required to secure an appointment.

The deposit is payable when the appointment is booked and is deducted from the total survey fee. The remaining balance is

£150 for a £250 non-intrusive damp survey

£275 for a £375 pre-purchase damp survey.

The outstanding balance must be paid before the completed report is released.

3. Cancellation or rescheduling

If you need to cancel or reschedule an appointment, please contact Professional Estate Services as soon as possible.

If you request to reschedule your appointment with at least 48 hours' notice, your £100 deposit will be transferred to the new appointment.

If you cancel an appointment with less than 48 hours' notice, the £100 deposit may be retained, subject to any applicable consumer rights.

4. No access to or failed appointment

The consumer is responsible for ensuring that the surveyor can gain safe and reasonable access to the property at the agreed appointment time.

If the surveyor attends the property but cannot gain access because of circumstances attributable to the customer, the £100 deposit may be retained, subject to any applicable consumer rights.

If the surveyor cannot proceed because the property is inaccessible or because the customer has not provided the required access, the appointment may be treated as a failed appointment.

5. Appointments and access: Customers are responsible for providing accurate property and contact information when making a booking.

The customer must ensure that safe and reasonable access is available to the area of the property that are to be inspected.

Where access to a particular area is unavailable, restricted, or considered unsafe, that area may not be inspected and this may be noted in the survey report.

6. Nature of the survey: Surveys provided by Professional Estate Services are non-intrusive visual inspections. No destructive investigation is undertaken. This means that materials such as flooring, skirting boards, walls, or other parts of the property will not normally be removed or damaged as part of the survey.

A non-intrusive survey cannot identify every concealed defect or source of moisture that may exist within the property.

7. Survey report: A written report will be prepared following the survey.

The report will reflect the observations and information available to the surveyor at the time of inspection.

The report should not be regarded as a guarantee that a property is free from damp, moisture-related problems, defects, or other building issues.

Where appropriate recommendations may be provided for further investigation or specialist surveys.

8. Cancellation by Professional State Services

If Professional State Services needs to cancel an appointment and cannot offer a suitable alternative appointment, the £100 deposit will be refunded.

9. Property information

Customers should provide accurate and complete information about the property and any known issues that may be relevant to the survey.

The surveyor should be informed of any known hazards, restrictions, or circumstances that could affect safe access to the property.

10. Payments

Payments are processed securely through the payment provider presented during the online booking process.

Professional Estate Services does not retain customers' full card details.

11. Acceptance of these terms

By booking a survey, the customer confirms that they have read and understood these terms and conditions and agreed to them, subject to any rights they may have under applicable consumer law.

The customer also confirms that the information provided when making the booking is accurate to the best of their knowledge.

12. Contact

If you have any questions about these terms and conditions or your booking, please contact Professional Estate Services using the contact details provided on the website.

Important note: These terms and conditions are intended to explain the booking arrangements and service provided by Professional Estate Services. They should be reviewed and amended where necessary to reflect the business's actual policy and legal requirements.

13. LIMITATION OF LIABILITY & SCOPE OF ENGAGEMENT

Scope of the Survey and Report

The Damp Survey and subsequent Report are provided solely for the purpose of identifying apparent diagnostic signs of dampness, timber decay, or atmospheric condensation within the visible and accessible areas of the specified property at the exact date and time of inspection.

The Survey is non-destructive and non-invasive. The Consultant will not move heavy furniture, lift floorboards, remove fitted carpets, or dismantle elements of the building structure unless explicitly agreed in writing beforehand. Consequently, no liability is accepted for defects obscured by fixtures, finishes, or stored goods.

14. Limitation of Financial Liability

To the maximum extent permitted by applicable law, the total aggregate liability of the Consultant to the Client for any and all claims, losses, costs, damages, or professional negligence arising out of or in connection with the Survey and Report—whether in contract, tort (including negligence), breach of statutory duty, or otherwise—shall be limited to a maximum sum of £250,000 (Two Hundred and Fifty Thousand Pounds Sterling).

The Consultant shall under no circumstances be liable to the Client for any indirect, special, or consequential financial losses, including but not limited to loss of profit, loss of revenue, or loss of business opportunity.

15. Third-Party Reliance

The Report is prepared exclusively for the confidential use of the named Client.

No liability or responsibility is accepted to any third party (including subsequent property purchasers, mortgage lenders, or tenants) who may see or rely upon the contents of the Report without the express prior written consent of the Consultant.
